TERMS AND CONDITIONS OF SALE
1. Parties entering contract for sale incorporating the Terms and Conditions:
Seller: "Nomadic Display" is Nomadic Display Inc. selling products to Customer as defined by these Terms and Conditions. Nomadic Display is located at 5617 Industrial Dr. Suite E, Springfield, VA 22151. Contact info: 800/732-9395 or CS01@nomadicdisplay.com.
Buyer: "Customer" is the legal entity or person identified in Nomadic Display's quotation or invoice.
2. Orders
2.1 No order will exist until Nomadic Display accepts the Customer's order and notice of acceptance by Nomadic Display has been received by the Customer. The order is deemed to be accepted when the Customer receives said acceptance from Nomadic Display.
2.2 Nomadic Display has the right to modify these selling terms and conditions by publishing the new version on its web site.
2.3 The products sold are subject to the Terms and Conditions. The Customer acknowledges that it is aware and agrees to the contents and is bound by the Terms and Conditions.
2.4 These Terms and Conditions are subject to U.S. laws
3. Cancellation
3.1 Cancellations for accessories and replacement parts are accepted within 24 hours of order placement for non-rush shipments. Orders requested by the Customer and agreed by Nomadic Display to be delivered in less than standard turn time as set by Nomadic Display are deemed to be "rush shipments" and are non-cancelable. A cancellation fee of 5% will be applied to the Customer's account prior to any refund being issued. The remaining amount will be credited back to the Customer's credit card originally used for payment.
4. Price and Payment
4.1 Nomadic Display accepts Visa, MasterCard and American Express.
4.2 Unless agreed upon by Nomadic Display, payment in full shall be made prior to production of product.
4.3 Customer shall pay for all shipping and handling charges
4.4 Customer shall be liable for all taxes and/or levies associated with the order to include but are not limited to government, state and local sales, use, goods and services, value added, excise, privilege etc.
4.5 Receipt of payment by Nomadic Display is not notice of acceptance of the order. Nomadic Display reserves the right to return the payment to the Customer and not accept the Customer's order due to incompatible product mix.
4.6 Nomadic Display has the right to modify its prices and delivery fee and to reject an order that presents incorrect amounts without written notice.
5. Returns
5.1 Unused product in its original condition and packing materials may be returned for a full refund if Nomadic Display's Customer Service is notified within 3 business days of receipt of the shipment by the Customer.
5.2 The shipping costs back to Nomadic Display are the responsibility of the Customer.
5.3 All sales of special order fabric colors (other than Coal, Silver and Imperial) are final and cannot be returned for a refund.
5.4 Nomadic Display will not accept returns if the Customer does not notify Nomadic Displays' Customer Service and have confirmation of returned delivery to Nomadic Display within 30 business days of receipt of the product by the Customer. Returns are not accepted beyond 30 business days
5.5 The customer must call 800/732-9395 to obtain the required Return Authorization Number (RA#) to accompany the product shipment in order for Nomadic Display to accept returned product from the Customer and refund to be given.
5.6 All return inquiries from 4 business days up to 30 business days are subject to a 10% restocking fee. Product must be unused and in its original condition and packing materials.
6. Title and Delivery
6.1 Title to and risk in the products shall transfer to the customer FOB Origin.
6.2 Nomadic Display shall not be liable for any delay in delivery of the products due to any information/specifications required from the Customer in order to produce the products, howsoever caused.
6.3 Nomadic Display will not be held responsible for late delivery or no delivery caused by strikes, war and natural disaster.
7. Warranty
7.1 Product lines Instand, XPlus and SignLine Standard have a "No Questions Asked" Lifetime Warranty. If the product fails to function properly, for any reason, Nomadic Display will repair or replace the frame or magnetic mounting system, free of charge.
7.2 Product lines Platinum, DesignLine, FabriMural, Traveler and LitStand Lite have a Lifetime Warranty. Nomadic Display will repair or replace your product if it fails due to defective materials or workmanship for the lifetime of ownership.
7.3 Product lines ImageMaker, Ideal, SignLine Swift and SignLine Express, Counter, Kiosks and SpaceStrut have a One Year Warranty. Nomadic Display will repair or replace the product due to defective materials or workmanship for a period of one year from date of purchase.
8. Liability
8.1 Nomadic Displays total liability for each order or connected events shall not exceed the total price paid for the purchase of products under these Terms and Conditions as allowable by law.
8.2 Nomadic Display shall not be liable to the Customer for any consequential or circumstantial damages arising out of or in connection with the Order or use and performance of products.
8.3 Nomadic Display shall not be liable for and has the right to correct any typographical, clerical or other error in this web site, quotation, acceptance offer, invoice or other correspondence provided by Nomadic Display allowable by law.
